Welcome to the DevShift website. These Terms of Use (the "Terms") govern your access to and use of the DevShift website, including all content, pages, forms and services available on it (together, the "Site").

Please note: the Hebrew version of these Terms is the primary and authoritative version. This English text is provided as a convenience translation only. In the event of any discrepancy, the Hebrew version prevails.

Please read these Terms carefully before using the Site. By browsing or otherwise using the Site, you accept these Terms in full. If you do not agree to any part of them, please refrain from using the Site.

1. Acceptance of Terms

Use of the Site is subject to these Terms and to all applicable law. By entering, browsing or using the Site or any of its services, you confirm that you have read, understood and agree to be bound by these Terms.
If you are using the Site on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.
DevShift may update these Terms from time to time, as described in the "Changes and Contact" section below. Continued use of the Site after an update constitutes acceptance of the revised Terms.

2. Use of the Website

We make the Site available for your personal, lawful and fair use, in accordance with these Terms. You may browse the Site, review its content, contact us and subscribe to our updates.
Prohibited uses. When using the Site, you must not:
  • use the Site for any unlawful, harmful, deceptive purpose or in breach of these Terms;
  • interfere with the proper operation of the Site, including any attempt to penetrate, overload or circumvent its security measures;
  • automatically collect data from the Site (scraping/crawling) without our prior written permission;
  • upload content or messages containing viruses, malicious code or any other harmful component;
  • impersonate any person or entity, or submit false information through the Site's forms;
  • use the Site's content for commercial purposes without DevShift's prior written consent.
We may, at our reasonable discretion, restrict or block access for any user who breaches these Terms or misuses the Site, without prejudice to any other remedy available to us under law.

3. Intellectual Property

All intellectual property rights in the Site and its content — including the design, text, graphics, the "DevShift" name and logo, photographs, illustrations, code, site structure and all other materials — are the exclusive property of DevShift or of those who have licensed their use to it, and are protected under intellectual property laws in Israel and worldwide.
You may not copy, reproduce, distribute, publish, translate, reverse-engineer or make any commercial use of the Site's content, in whole or in part, without DevShift's prior written consent, except for reasonable personal use as part of ordinary browsing of the Site.
Client logos and testimonials. Names, trademarks, logos and testimonials of clients and third parties displayed on the Site are the property of their respective owners and are shown with their permission and for identification purposes only. Their display grants you no rights in them.

4. Our Products and Services

The Site is an informational and marketing website. The content presented on it about DevShift, its capabilities, services and products is general information only, and does not constitute a binding offer, a contractual commitment or any professional advice.
Standalone products. DevShift products and services mentioned on the Site, including RoadProtect and Formalingo, are operated as separate services and are governed by their own terms of use and privacy policies. These Terms do not apply to them, and use of those products is subject to the specific terms applicable to each.
Quotes and engagements. Any quote, proposal or engagement on a development project is a separate engagement, set out in a dedicated agreement or engagement document between DevShift and the client. The content of the Site does not create such an engagement and does not replace it.

6. Disclaimer of Warranties

The Site and its content are provided on an "AS IS" and "AS AVAILABLE" basis, without any representation or warranty of any kind, whether express or implied.
We strive to keep the Site accurate, current and available, but we do not warrant that the information on the Site will be complete, accurate or up to date at all times, that the Site will operate without faults or interruptions, or that it will be free of viruses and harmful components. Information on the Site may change from time to time without prior notice.
You should not rely on the information on the Site as a substitute for professional advice tailored to your circumstances. Any reliance on the Site's content is at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, DevShift, its officers, employees and providers shall not be liable for any damage — direct, indirect, consequential, special or otherwise — caused to you or to any third party as a result of using the Site, the inability to use it, or reliance on its content, including loss of profits, loss of data or harm to reputation.
Nothing in the above limits any liability that cannot be limited or excluded under applicable law, including liability for personal injury caused intentionally or through gross negligence.
Use of the Site is at your own risk, and you are responsible for any equipment and software required to access it.

8. Privacy

Use of the Site is also subject to our Privacy Policy, which forms an integral part of these Terms. The Privacy Policy explains what details we collect through the contact form and newsletter sign-up, how we use them, and your rights to access, correct and delete your information under the Israeli Privacy Protection Law, 5741-1981 (including Amendment 13) and, for EU visitors, in line with GDPR principles.
The Site itself does not use tracking cookies by default. Any future analytics or marketing tools will run only after you have given your consent, according to the categories detailed in the Privacy Policy.

9. Governing Law and Jurisdiction

These Terms and any use of the Site are governed solely by the laws of the State of Israel, without giving effect to its conflict-of-laws rules.
Exclusive jurisdiction over any dispute relating to these Terms or to the use of the Site lies with the competent courts of the Tel Aviv–Jaffa District, and with them alone.

10. Changes and Contact

We may update these Terms from time to time to reflect changes to the Site, to our services or to legal requirements. The updated version will be published on this page, and the "Last updated" date will be amended accordingly. Material changes take effect upon publication.
We recommend reviewing the Terms periodically. Continued use of the Site after an updated version is published constitutes acceptance of the revised Terms.
